PLAY OCTOPUS CONTEST (the “Contest”)
OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

ELIGIBILITY: This Contest is open only to legal residents of the contiguous United States and the District of Columbia, who are 18 years of age or older at the time of entry. You need not be present to win. Employees, officers, directors, representatives, independently contracted drivers and agents (and members of their immediate families or those living in the same household) of Play Octopus LLC (“Sponsor”) and its subsidiaries, parent companies, affiliates, and promotional agencies (the foregoing individuals and entities, collectively the “Contest Parties”) are not eligible to enter or win.
HOW TO ENTER: Each Contest begins at 3:01 a.m. ET each day and ends at 2:59 a.m. ET each day. You may enter each Contest by playing a game on an Octopus tablet as a passenger in a ridesharing vehicle, and if achieving a high score, submitting your email address or phone number via the tablet. You may enter each Contest as many times as you wish. Alternatively, you may submit a written request to play to Sponsor’s address specified below. Written requests must include your name and mailing address. Illegible, incomplete and duplicate entries will be disqualified.
PRIZES AND APPROXIMATE RETAIL VALUE: There will be one prize awarded to each Contest (the “Prize”). Each Prize consists of a $25 gift card to an online retailer. All federal, state, and local tax liabilities are the sole responsibility of the Grand Prize winners (“Winners”). Winners may be required to complete and return an IRS W-9 form (i.e. Request for Taxpayer Identification Number and Certification).
SELECTION OF WINNER: Each Prize Winner will be selected by Sponsor based on the highest score among the entrants. Winners will be notified by e-mail or SMS text message within one week of winning. Only one Winner per household will be permitted.
PRIZE CONDITIONS: No substitution for any prize will be permitted. Prize is not transferable, assignable or redeemable for cash. Winners must accept Prize within ten (10) days of being notified. Winners may be required to execute and return an Affidavit of Eligibility and Publicity/Liability Release within fifteen (15) days of issuance. Failure to accept or return all required documents in the specified time periods may result in Winners being disqualified and an alternate Winner selected. By entering this Contest and/or accepting the Prize, Winners and entrant hereby consent (except where prohibited by law) to the reasonable use by Sponsor of the Winners’ and entrants’ photograph, voice, likeness and/or image, city of residence, contents of the entry form and the name and age of the Winners and entrants without any further compensation for any future promotional activity related to this Contest.
ODDS OF WINNING: Odds of winning a Prize depend on the total number of eligible entries received for the Contest and are equal regardless of method of entry.
CONDUCT OF PARTICIPATION: By entering the Contest, entrant affirms that he or she has read and agrees to abide by the Official Rules and the decisions of the judges. Sponsor reserves the right to disqualify any entrant acting in violation of the Official Rules or found tampering with the entry process or with the operation of the Contest. The Contest is governed by the laws of the United States and, by entering, all Winners and entrants hereby submit to the jurisdiction and venue of the federal, state and local courts located in Baltimore, Maryland. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR MOBILE APP RELATED TO SPONSOR OR THE CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATIONS OF LIABILITY: Sponsor and each of its respective affiliates, subsidiaries, parent corporations, and their respective officers, directors, shareholders, employees and agents, are not responsible for any incorrect or inaccurate entry information, theft, tampering, destruction, or unauthorized access to, or alteration of entries; printing or other errors; and any entries or mail which are late, lost, delayed, incomplete, misdirected, stolen, mutilated, illegible, postage due or any combination thereof. Sponsor reserves the right to modify, suspend or terminate the Contest in the event that it becomes necessary due to circumstances beyond Sponsor’s control. In the event the Contest is terminated early, a winner will be selected from all eligible entries received at the time of termination.
RELEASE OF LIABILITY: By participating, Winner and entrants agree to release, discharge, indemnify and hold harmless Sponsor and each of its respective affiliates, subsidiaries, parent corporations, and their officers, directors, employees, representatives and agents from and against any claims made by the Winner, entrants or any other third parties related in any way to the operation of this Contest, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest.

Advertiser Sweepstakes – Official rules

PLAY OCTOPUS ADVERTISER SWEEPSTAKES (the “Sweepstakes”)

From time to time, advertisers (the “Advertisers,” and individually, an “Advertiser”) on the Play Octopus platform (the “Platform”) may offer sweepstakes, promotions and giveaways through the Platform. In the event that an Advertiser provides a separate set of official rules, such rules shall entirely supersede these default rules, and these default rules shall not apply.

Drivers with account status “INACTIVE” must activate tablet for a minimum of +1 hour for eligibility. Employees (and their immediate families or those living in the same household) of Sponsor, and those of its affiliates, subsidiaries, divisions, parent and related companies, suppliers, printers and advertising, promotional and judging agencies are not eligible to enter or win.
HOW TO ENTER: The Contest begins at 12:01am (ET) on January 22, 2024 and ends at 11:59pm (ET) on January 25, 2024. You may enter the Contest by completing the contest entry form available on the Octopus Driver App.
PRIZES AND APPROXIMATE RETAIL VALUE: The Contest will award prizes in the form of a free cellular telephone, maximum retail value not to exceed $1,300. Octopus Mobile Terms of Service

OCTOPUS RIDER SMS PROGRAM
1. When you opt-in to the service, we will send you an SMS message related to the content for which you’ve expressed interest on our platform.
2. Users may receive messages related to prizes from games on our platform or advertisements they express interest in on our platform.
3. You can cancel the SMS service at any time. Just text “STOP” to 211112. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
4. If at any time you forget what keywords are supported, just text “HELP” to the short code. After you send the SMS message “HELP” to 211112, we will respond with instructions on how to use our service as well as how to unsubscribe.
